Documentation for Transplantation of Human Organs in Hospital

With the advance of science and technology particularly in the field of medicine and surgery it has become possible to remove organs from living as well as deceased persons and to transplant such organs to save the lives of suffering human beings. This advancement brought its evils as well. Commercial dealings in human organs especially kidneys, started increasing.

Thus a need for a comprehensive legislation for regulating the removal of organs from cadavers and living persons and prohibiting commercial dealings in human organs was felt.

The Transplantation of human Organs Act, 1994 provides for the regulation of removal, storage and transplantation of human organs for therapeutic purposes and for the prevention of commercial dealings in human organs and for matters connected therewith or incidental thereto.

The Act recognizes the concept of brain death and gives legal sanction for cadaver organ donation.

The Transplantation of Human Organ Rules, 1995 has provided format of the forms to be used in case of cadaver organ donation and resulting transplantation.

Form 5 /is a format for consent form of the donor before his/her death for the removal of human organs of donor after his/her death for therapeutic purposes. The donor forms can be downloaded from ORBO website.

Form 6 /or Form 7 /are to be signed by the person lawfully in possession of the dead body.

Form 8 /is brain death certificate which has to be signed by all the members of the Board of Medical Experts as referred to in sub-section (6) of section 3 of the Transplantation of Human Organs Act 1994.

Form 9 /is in case of brain-stem death of a person of less than 18 years of age. This form has to be signed by either of the parents of such person.
